GENERAL TERMS AND CONDITIONS OF SALE (GTC) – MASS-TRADING.FR

1. Scope

These General Terms and Conditions of Sale (GTC) apply to all sales concluded between:

MASS TRADING

(hereinafter “the Seller”)

and any professional buyer, legal entity, or individual entrepreneur (hereinafter “the Customer”) purchasing products via www.mass-trading.fr.

The website is strictly reserved for business customers and does not apply to consumers under the French Consumer Code.

2. Products

Mass-Trading.fr sells used and refurbished electronic products (smartphones, tablets, computers, networking equipment, accessories, etc.).

2.1 Product Categories

  • Used: Tested and functional products showing variable signs of use

  • Refurbished: Professionally restored, tested, and cleaned products

  • Wholesale / Lots: Bulk sales, sometimes with mixed grades

2.2 Grades & Technical Information

Each product is classified by aesthetic and functional grade (A+, A, B, C…).
Grades are clearly indicated on product pages and are binding on the Customer.

2.3 Availability

Offers are valid while stocks last.
The Seller reserves the right to modify the catalog at any time.

3. Website Access & Professional Account

Opening a professional account requires:

  • Business registration proof (Kbis or equivalent)

  • Valid VAT number (if applicable)

  • Acceptance of these GTC

The Seller may refuse account creation without justification.

4. Orders

By placing an order on the Website, the Customer accepts in full:

  • The GTC

  • Prices

  • Product information and grades

  • Ordered quantities

Orders are considered firm and irrevocable upon validation by the Customer.

The Seller reserves the right to:

  • Refuse orders in case of prior disputes

  • Limit quantities

  • Require immediate payment or deposit

5. Prices

Prices are indicated in Euros:

  • Excluding VAT (HT), if standard VAT applies

  • Including VAT (TTC), if margin VAT regime applies

Prices exclude delivery charges and may be modified at any time due to:

  • Market fluctuations

  • Availability

  • Supplier prices

  • Product grade variations

The applicable price is the one displayed at the time of order.

6. Payment

6.1 Payment Methods

Payments can be made via:

  • Credit card

  • Bank transfer

  • Secure online payment (3D Secure)

  • Deferred payment (conditions apply)

6.2 Payment Terms

Unless otherwise agreed in writing, all orders are payable in full upon ordering.

7. Delivery

7.1 Delivery Areas

Shipping is available to mainland France, the EU, and other areas on request.

7.2 Transport & Risk Transfer

Goods travel at the Customer’s risk, in accordance with B2B trade rules.

Risk transfers:

  • Upon delivery to the carrier

  • Or upon collection by the Customer

7.3 Delivery Time

Delivery times are indicative only.
Delays do not give rise to compensation in a B2B context unless otherwise agreed in writing.

8. Receipt – Reservations

Upon delivery, the Customer must:

  • Inspect the parcels

  • Note precise reservations on the delivery slip

  • Notify the carrier within 3 business days (art. L133-3 French Commercial Code)

Failure to issue reservations voids claims related to transport.

9. Warranty

9.1 Commercial Warranty

Used or refurbished products may have a commercial warranty, 1 to 12 months, depending on type and grade.

9.2 Exclusions

The warranty does not cover:

  • Breakage, shocks, oxidation

  • Misuse

  • Unauthorized modifications or repairs

  • Normal wear and tear (batteries, consumables)

  • Mixed-lot products or “for parts” / Grade C

9.3 Warranty Returns

All returns must be validated by customer service with an RMA number.
Products must be returned complete and in original condition.

10. Right of Withdrawal

No right of withdrawal applies, in accordance with the French Consumer Code, as sales are exclusively for professional customers.

11. Liability

The Seller is not liable for:

  • Data loss

  • Indirect damages

  • Business losses

  • Software incompatibilities

  • Loss of profits

Liability is limited to the value of the order.

12. Retention of Title

Products remain the property of Mass-Trading until full payment is received (art. L624-16 French Commercial Code).

The Seller may reclaim unpaid products and require their return.

13. Intellectual Property

Any reproduction of website content (photos, text, product descriptions, grades, trademarks, structure) is strictly prohibited without prior written authorization.

14. Personal Data – GDPR

Mass-Trading processes professional data for:

  • Account management

  • Orders and billing

  • Customer service

15. Governing Law & Jurisdiction

These GTC are governed by French law.

In case of dispute, the exclusive jurisdiction lies with the courts of the Seller’s registered office, even in the case of multiple defendants or third-party claims.

16. Acceptance of GTC

By confirming an order, the Customer declares that they have read, understood, and accepted these GTC without reservation.
